1. Area of Applicability
1.1. These terms and conditions apply to all orders placed by customers on the Ecoclean GmbH, Hertistr. 8, 5704 Egliswil (VAT number: CHE-109.329.866) online shop.
1.2. By placing an order, the buyer agrees to accept these general terms and conditions.
1.3. Buyer's terms and conditions differing from those herein shall not be recognised.
2. Offer and Conclusion of Contract
2.1 Products displayed in the online shop do not constitute a legally-binding offer, but act as a prompt to encourage orders.
2.2 The customer enters into a binding order for all products listed on the order page by clicking the order button.
2.3 Ecoclean GmbH will confirm your order by email after receiving it.
3. Prices and Shipping Costs
3.1 The prices listed on the product page are in Swiss Francs (CHF) and exclude legally required VAT and other costs involved (postage, packaging). The specific shipping costs will be displayed for the customer to review during the order process.
3.2 There are no further taxes or charges.
3.3 The supplier reserves the right to amend the prices at any time. The prices displayed on the website on the day of ordering apply to the customer.
4. Terms and Conditions of Delivery
4.1 Physical items are delivered within Switzerland and the Principality of Liechtenstein.
4.2 Ecoclean GmbH endeavours to deliver goods within 7 working days for deliveries within Switzerland and the Principality of Liechtenstein.
However, production or supply bottlenecks can result in delayed deliveries, in particular. Information on availability and delivery times is, therefore, not guaranteed and is subject to change.
The customer will be informed when an order cannot be delivered within the intended delivery period, if that can be predicted in advance.
4.3 Ecoclean GmbH is entitled to partial deliveries should all of the ordered products not be in stock.
4.4 Ecoclean GmbH is entitled to withdraw from the contract should the goods not be delivered after three failed delivery attempts for which the customer is at fault. Any payments already made will be refunded immediately.
5. Payment Terms and Conditions
5.1 Swiss customers have the option of paying by invoice, against prepayment, or by credit card or PayPal. Ecoclean GmbH is not obliged to offer payment to all customers by invoice.
5.2 Credit card or PayPal payments are taken from the customer's account at the time of ordering. Payment must be in Swiss Francs. There is a payment period of 30 days for invoices.
5.3 Customer counter-claims may only be offset if they are recognised and have been legally determined.
5.4 The customer can invoke their right to retain possession of goods insofar as their claims are based on the same contractual relationship.
6. Retention of Ownership
Items remain the property of Ecoclean GmbH until full payment has been made. Prior to the transfer of ownership, the buyer is prohibited from pledging, assigning, processing or altering the deliverables without the agreement of Ecoclean GmbH. EcoClean GmbH is entitled to record an appropriate entry in the registry of ownership.
7. Cancellation Rights
7.1 Customers have the right to cancel their order within 14 days of receipt of goods. The cancellation must be made by email or letter to Ecoclean GmbH. For the cancellation to be accepted, it must be sent within the designated time period. The customer is not required to provide a reason for the cancellation. The cancellation notice must be sent to:

7.2 The sales contract will unwind once the customer has invoked the right to cancel in which case any services received as part of the sales contract must be refunded. The customer must return the goods to Ecoclean GmbH in their original packaging within 14 days after notification of the cancellation. The customer must bear the cost of returning the items.
7.3 The purchase price, insofar as it has already been paid, will be refunded to the customer immediately upon receipt of the goods. The company reserves the right to deduct from the price should the goods be damaged in some way or exhibit excessive wear. No deductions will be made to the price should the loss of value be attributed to any actions taken that were necessary to determine the type, sort and effect to the functionality of the goods. Ecoclean GmbH may refuse to refund the goods until they have been received and/or until the customer has provided evidence that they have been returned, depending which event takes place earlier.
7.4 The cancellation right does not apply in the following cases:
Bespoke business solutions that were undoubtedly tailored to the customer's specific needs
Services that have already been rendered in their entirety or are in the process of being rendered.
8. Quality Guarantee
8.1 Ecoclean GmbH guarantees that its goods meet the quality promised to customers and that there are no considerable shortcomings in terms of their merit or capabilities. It also assures that goods perform according to the abilities and specifications previously laid down. Ecoclean GmbH reserves the right to remedy any existing defects by repair or the delivery of an adequate replacement.

8.3 The customer is entitled to withdraw from the contract should he fail to receive a repair or replacement. This does not apply in the case of insignificant defects. The customer does not have a right to a price reduction.
9. Password / Confidentiality
The customer is obliged to keep any data or passwords created to access online products strictly confidential and to handle them with the utmost care. Ecoclean GmbH reserves the right to immediately terminate authorisation to use the site in the event that it detects access data have been used multiple times by someone other than the authorised person.
10. Copyright
The content and composition of products advertised by Ecoclean GmbH and all of its online services are copyright protected, and protected in other legal ways. The customer is permitted to use texts and guidance documents for their own use, but partially or entirely sharing the document requires the express agreement of Ecoclean GmbH.
11. Data Protection
Ecoclean GmbH is entitled to process customer data received in conjunction with the contractual relationship in accordance with the applicable data privacy laws and particularly with the Swiss Data Protection Act (DSG). Customers' personal data will be treated confidentially and only shared with third-parties in the event of a credit check.
12. Liability
Ecoclean GmbH discharges itself from liability in the event of minor or moderate negligence, indirect and moderate loss and consequential loss, profit loss, in addition to loss owing to late deliveries. That is independent of whether the liability is contractual or external to the contract.
This also applies to liability for auxiliary persons and assistants. Ecoclean GmbH assumes no responsibility for any errors over which they cannot exercise control and which are the fault of telecommunication or hosting providers, or any other third-party service provider.
13. Court of Jurisdiction and Applicable Law
The contract between the customer and Ecoclean GmbH is governed by Swiss law. The United Nations Convention on Contracts for the International Sale of Goods, established on 11 April 1980, shall not apply. The court of jurisdiction for any disputes arising from the contract shall be the ordinary court in Lenzburg. For consumers, the legal places of jurisdiction are valid.
14. Final Provisions
Should parts of these general terms and conditions be deemed to be unenforceable, that shall not affect the validity of the remaining conditions of this contract. Any relevant legal provisions shall be considered valid in place of the unenforceable conditions.
